Mining Regulatory Clarity Act Key to U.S. Mineral Independence

Dear Friend,

The stakes for America’s mineral security have never been higher. Our country’s reliance on imported minerals – especially from China – remains a looming threat to our economy and national security. Unless we take immediate and decisive action to strengthen domestic minerals production, these risks will only become more pressing. This is why, as members of Congress return to Washington, D.C., they must act swiftly to pass the Mining Regulatory Clarity Act.

The Mining Regulatory Clarity Act of 2025, offered by Senators Catherine Cortez Masto (D-Nev.) and Jim Risch (R-Idaho), with companion legislation in the House by Representatives Mark Amodei (R-Nev.) and Steven Horsford (D-Nev.), would be an important step forward in addressing America’s import-reliance for minerals. This legislation directly addresses the confusion and operational challenges created by the flawed 2022 Center for Biological Diversity v. U.S. Fish and Wildlife Service decision, which reversed more than 150 years of legal precedent and responsible mining practices in the United States.

Notably, the Mining Regulatory Clarity Act does not permit or expand mining on protected or conserved lands, and does not restrict access to lands for other multiple-use activities. Instead, the bill restores clarity and certainty, enabling responsible mining operations to proceed efficiently on federal lands – unlocking our vast domestic resources and supporting our national security, energy and manufacturing sectors.

Recently, we have seen the U.S. Geological Service do the right thing by adding copper, uranium and many other minerals to the agency’s Critical Minerals List. This is a welcome and necessary recognition of these minerals’ strategic importance. However, until Congress acts to remove the regulatory stumbling block created by the 2022 decision, progress will be limited. We must align these priorities to ensure America can fully capitalize on its mineral potential.

By moving quickly, lawmakers will show the world that America is serious about securing its mineral future, protecting our economy and safeguarding our national security. Thank you for your continued partnership and commitment to building a stronger, more secure America.
